Act of renunciation and sworn statement so that the act has legal effects on an international level

On the day 5 July 2011, in La Valletta on the island of Malta, in the presence of the Notary Public Antoine Agius

I, Giovanni Caporaso Gottlieb, Regent Prince of the Government of Antarcticland (an unrecognized State).

DECLARE

That in my full capacity, as Regent of Antarcticland and Grand Master of the Sovereign Order of the Knights of Antarcticland, seeing that my health conditions impede me from carrying out the business of the Order and the State in an absolute and complete manner, I administratively divide the State of Antarcticland into two Principalities with the following characteristics:
• The Principality of Antarcticland
Capital: Cape Gott
Authority: H.H. Prince of Antarcticland
Territory: the lands, islands, and territorial waters that extend from the South Pole to 60° S latitude and comprised between the 90° W and 120°W longitudes.
• The Principality of West Antarctic
Capital: Princeburg
Authority: H.H. the Prince of West Antarctic
Territory: islands, and territorial waters that extend from the South Pole to 60° S latitude and comprised between the 120° W and 135° W.
The National Territory remains undivided and the Principality of West Antarctic will have complete administrative autonomy, although the Prince will not have the faculty of emanating laws and/ or determining foreign policy for the Government of Antarcticland, nor will he be able, in any case, to decide differently by himself without the consensus of the Regent, which must take place through a Decree of the Regency Council.
H.H. the Prince of West Antarctic will have all the rights of administrative management of the Principality of West Antarctic and the right to vote in the Council of the Princes and Knights.
The national and foreign policy will remain part of the competency of the Supreme Council of Regency, the Regent of Antarcticland and the Grand Master of the Order, which constitute the Supreme Council of Regency.

I ALSO DECLARE

In the capacity of Grand Master of the Sovereign Order of the Knights of Antarcticland and Regent of the self-proclaimed State of Antarcticland, being in possession of my full mental faculties and in definitive and non-retractable form, according to the Articles IX and X, Paragraphs I and II, of the Constitution of Antarcticland, renounce being the Regent and Grand Master of the Order and nominate, constitute and invest my successor with all the rights and constitutional prerogatives that belong to him, including those that are dynastic.

I DECREE

With Decree N. 1/2011 of Antarcticland the modification of Articles VIII and IX of the Constitution of Antarcticland by creating the Supreme Council of Regency composed of at least three (3) members and a maximum of five (5), mainly the Regent, two co-Regents and two Advisory Counselors. Prince Rolando Righetti has been designated as my successor to the Regency and as Grand Master of the Order, with immediate effect. The new Regent of Antarcticland will pledge and swear, according to Article X of the Article of Antarcticland, to govern according to the historical legacy that has been handed down to him and to do everything in his power to obtain recognition of Antarcticland by the United Nations and/ or other International Organizations and/ or other Sovereign Nations through their constitutional governments. The Council of the Regency will have to establish the norms and laws that regulate it and nominate a Counselor who will have the right to an advisory or deliberative vote.
For the purpose of making known the financial situation of the State of Antarcticland, I declare that the balance is at zero (0) and that there are neither debits nor credits.
 All of the existing documentation, excluding none, including non-issued documents for proof of identity and electronic archives, will be consigned by me, in their original form, to the regent of Antarcticland who, when he enters into office, will have to carefully examine all of the documentation made available to him by H.H.S. Giovanni Caporaso Gottlieb. The Regent must take possession and knowledge of all documents within 20 days after signing this act of abdication, overthrow and perpetual renunciation.
Today, I, Prince Giovanni Caporaso Gottlieb, take upon myself the tile of H.H.. Prince of West Antarctic, with the Right to Administrative Independence for the territory of the Principality of West Antarctic, with absolute power over the lands, islands and territorial waters that extend from the South Pole to 60° S. latitude and comprised between the 120° W and 135° W longitudes; I also maintain the life-time seat that is my right in the Sovereign Council of the Princes and Knights of the Order, under the auspices of always being able to aid the development of Antarcticland.
To that end, I specify that the title of Prince of West Antarctic will have all the dynastic rights De Jure relative to the Principality, territory that cannot be ceded and will remain undivided with the territory of Antarcticland that will be its political administrator.

I ALSO DECLARE

That on the date of 17 October 2007, I notified the Secretary General of the United Nations, through the Supreme Court of New York, County of New York, United States of America, with a receipt signed Damaris de los Santos, Judiciary Officer licensed by the State of New York with a confirmation of delivery form in conformity to the CPLR –section 3215 (g) 3 (i) on 10.12.2007 with a confirmation of receipt of the renunciation of the lands formerly belonging to the order and the confirmation of the claim on the dominion over the lands and the islands denominated “Antarcticland” that extend from the South Pole to 60° S. latitude and comprised between the 90° W and 135° W longitudes, with a total area of 1,544,424 Km2.
The notification was carried out based on the jus gentium law and the right to auto-determination of the peoples recognized by the Magnum Carta of the United Nations and by other regional and international instruments including the Declaration of the Principles of International Law Regarding Friendly Relations and Cooperation among States adopted by the General assembly of the UN in 1970; the Helsinki Final Act adopted by the conference on Security and Cooperation in Europe (CSCE) of 1975; the African Charter of Human and Peoples’ Rights of 1981; The CSCE Charter of Paris for the new Europe adopted in 1990; the Declaration of Vienna Program for Action of 1993 and reconfirmed in the International Court of Justice of Namibia, the case of the Western Sahara and Eastern Timor in which the right was recognized erga omnes.
The Order, initially in the person of Prince Fabian Gottlieb and then of his successors, has always been in possession of the claimed lands and the dominion since 1821 when they were discovered and the concession of the Principality by Tsar Alexander I, and in particular have always been the guardians of the above.
This declaration has been sworn to before the Notary Public Dr. Antonio Agius of Malta, and has been released according to the ancient laws of Antarcticland and to international law, at La Valletta, Malta, so that they are juridically valid before any Knightly and Governmental or National Order.
